Mandatory Retirement at age sixty-five (65)
BCMEA takes policy position to abolish mandatory retirement & encourages ILWU to do the same. In December 2009, BCMEA wrote the ILWU advising of its policy position to eliminate mandatory retirement as “the law in this area was “migrating” towards the abolishment of mandatory retirement at a specific age”. BCMEA further stated “given this legal and social trend, BCMEA’s policy position is that workers who turn age 65 and who are not in receipt of a pension should be entitled to choose between retiring and continuing to work as longshore or foremen employees.” BCMEA had extended an invitation to all the ILWU Longshore Locals to join the BCMEA in championing this proactive change to the industry. However, to date, the ILWU has declined that invitation which is necessary to implement the change.

Olympic Transportation Plan
Due to the potential impact of the 2010 Olympics on transportation to the North Shore, BCMEA has made arrangements for the transportation of workers to and from dispatch to their work sites. This plan will be in effect from Feb. 9, 2010 to Feb. 28, 2010 and applies only to the 0800 and 1630 shifts. Taxi’s will continue to be used for 0100 shift as well as Port Moody.

BCMEA Arbitration Win: Cruise Ship Shore Power
A Union jurisdictional claim relating to the provision of Shore Power at Canada Place Cruise Ship Terminal was successfully concluded at arbitration. The Port of Metro Vancouver, Holland America, Princess Cruises, and both the Provincial and Federal Governments have been working cooperatively on a Shore Power project that involved a combined investment of 9 million dollars. The principle objective was to provide electrical power to cruise ships docked at the Canada Place Cruise Ship Terminal. This “green” initiative would allow the cruise ships to shut down their diesel engines and thereby reduce their air emissions while berthed in and around the inner harbour in Vancouver This matter was heard by an Arbitrator over a period of three days: June 08, July 03 and 17, 2009. Upon considering the parties evidence and submissions the Arbitrator dismissed the Union’s claim to the work by finding that the work in question was not work covered by the Collective Agreement. In reaching this conclusion the Arbitrator made two primary findings: 1. The electrical contractor was contracted by the Port Authority to do the installation of the Shore Power equipment and not by a BCMEA member. 2. As neither the electrical contract nor the Port are members of the BCMEA the work could not fall under the jurisdiction of the Collective Agreement.

There are a limited number of positions available in the following trades:

Industrial Electrician
Millwright

The completed application form is to be placed in a box located in the Vancouver Dispatch Hall, the Local 502 Dispatch Hall, the ILWU Local 500 office or emailed to jobs@bcmea.com.  

Application deadline is April 2, 2009.  

Applications will only be accepted from Longshore workers covered by the BCMEA/ILWU Collective Agreement.  

Applicants will be expected to meet provincial standards before being registered as an apprentice. Applications will be retained for future use.

The posting for the Joint BCMEA/ILWU Local 500 2009 training program is up at the union hall. If you wish to apply for training in 2009 please be sure that you complete an application form by October 16, 2008. Lists are not carried over from year-to-year so if you want to be considered for 2009 training, you must re-apply.

3rd Annual Canada Maritime Conference

The Journal of Commerce Conferences and Canadian Sailings magazine are pleased to announce the 3rd Annual Canada Maritime Conference, September 30 – October 1, 2008, at the Sheraton Vancouver Wall Centre Hotel in Vancouver, Canada. This year’s conference will feature senior-level officials representing carriers, terminal operators, shippers, the logistics and supply chain industries, labour, security and the environment.

The conference, which is hosted by Port Metro Vancouver, examines issues and trends involving important trade lanes for Canadian ports, shippers and transportation and logistics providers. The theme of the 2008 conference, “Supply Chain Transparencies,” the program will focus on developments and challenges in Asian, European and other major supply chains with Canada, as well as issues and regulations impacting the flow of cargo. CURRENT APPLICANTS:
If you have already applied, please be aware that the processing time for the applications can take 2 weeks to 3 months. Your security clearance can be checked on-line using your mybcmea.com account. Alternatively you can check postings at Despatch Hall which are regularly updated with those employees who have been cleared to obtain your updated port pass.

If you do not have a mybcmea.com account call 1-866-GO-BCMEA (1-866-462-2632) to get your password.

Marine Transportation Security Clearance Program
As scheduled, the Federal Court of Appeal heard oral arguments on the ILWU’s applications this morning at 8:30 a.m.

The ILWU is asking the Federal Court of Appeal for 1) a stay of the CIRB order and 2) a stay of the MTSCP regulation.

The Federal Court of Appeal dismissed the ILWU’s applications to stay the CIRB Order and the MTSCP.

In dismissing the applications for interim stays, the Court held that the ILWU failed to establish that they would suffer "irreparable harm" by applying for TSCs.

Furthermore, the Court held that the balance of convenience did not tip in favour of ILWU. The Court noted that the "the public interest purpose underlying the Regulations is undeniable" and that harm to the Canadian economy and port business were significant. This weighed against granting the ILWU’s request for relief.

Accordingly, the CIRB order is effective tomorrow and the February 20, 2008 MTSCP implementation date applies.

Marine Transportation Security Clearance Program
As you are aware, the Government of Canada has introduced new security regulations regarding security clearances for certain waterfront employees. The new regulations became effective December 15, 2007, however, legislative exemption issued by the Federal Government extended the compliance date to February 20, 2008. They require Container Terminals and Cruise Ship Facilities to ensure that employees who work in certain positions or have access to designated restricted area(s) within these Facilities have received Transportation Canada Security Clearance by the February 20th deadline.

At this time Container Terminal Head Checkers, Electricians and Operational and Electrical Foremen who work at container terminals are required to have received a Transportation Canada Security Clearance by February 20, 2008. For more information about these regulations please go to:

Given the time Transportation Canada requires to process a security clearance application, it is necessary that employees requiring such clearance make application by January 21, 2008.

You can make your application between the hours of 8:00 am and 5:00 pm from January 7th through January 21st, 2008 at the following location:

At that time, you will be able to submit the completed application and be processed by the Commissionaires. Please see the attached How-To Guide and application form for details.

CIRB Decision - Marine Transportation Security
Please be advised that the Canada Industrial Relations Board issued its decision today on the Marine Transportation Security matter. The Association and intervenor employers were successful. The CIRB has declared that the ILWU has engaged in an illegal strike by directing its members to not apply for Transportation Security Clearance. Further details will follow shortly.

Fraudulent Applications for Longshore Recruitment
A fraudulent advertisement seeking Longshore applicants appeared on Craig’s List on Saturday 24 March 2007. The Vancouver Police Department has been notified and is actively pursuing the matter and working to close down the link.

The Vancouver Police Department advises anyone who may have attempted to apply for Longshore Worker positions through Craig’s List to contact the Canadian Credit Bureau through either Equifax at 1- 877-323 -2598 or TransUnion at 1-877-525-3823.

If you believe your personal information has been compromised, please contact the non-emergency number for the police in your municipality.
